Important Health Insurance Update

Health insurance coverage for current ICE employees is paid through November 30, 2014 only. Because the hearing on the preliminary injunction was rescheduled to December 16 and 17, 2014, the Receiver will be filing a motion for Court authorization to pay premiums to extend health insurance coverage for current ICE employees through December 31, 2014. If you are an ICE employee that wishes to formally resign from ICE and/or has found other employment, you must notify the Receiver immediately. The Receiver has been advised by the ICE health insurance plan administrator that if former ICE employees fail to notify the Receiver of their resignation or new employment to cancel existing coverage, they may be subject to personal liability for claims made to the ICE health insurance plan. ICE employees who resign are eligible to extend health insurance coverage through COBRA at their own expense.

The Court, with the consent of all parties, has re-scheduled the hearing on the FTC’s motion for preliminary injunction from November 24, 2014 to December 16 and 17, 2014. The purpose of the hearing is to determine whether the temporary restraining order should be dissolved or converted to a preliminary injunction. After the Court rules on the FTC’s motion for preliminary injunction, the Receiver will be in a position to provide additional information about the case, the status of ATS’s business and services, and the status of employee paychecks.

On November 10, 2014, the Federal Trade Commission (the "FTC") filed a Complaint in the United States District Court for the Southern District of Florida (the "District Court"), commencing the above captioned civil injunctive and enforcement action against Inbound Call Experts, LLC also d/b/a Advanced Tech Support, Advanced Tech Supportco, LLC, PC Vitalware, LLC, Super PC Support, LLC, Robert D. Deignan, Paul M. Herdsman, Justin M. Wright, PC Cleaner, Inc., Netcom3 Global, Inc., Netcom3, Inc. also d/b/a Netcom3 Software Inc., and Cashier Myricks, Jr. a/k/a Cashier Myrick (the "Defendants"). The FTC sought, among other things, the issuance of a temporary restraining order and the appointment of a receiver to manage the affairs of Inbound Call Experts, LLC, Advanced Tech Supportco, LLC, PC Vitalware, LLC, and Super PC Support, LLC (the "Receivership Defendants").

The District Court granted the FTC’s request for a temporary restraining order over the Defendants. The District Court also granted the FTC's motion to appoint a receiver for the Receivership Defendants, appointing Jeffrey C. Schneider as their Receiver. This is a temporary appointment at this time and the Defendants have a right to defend themselves in civil court and to challenge the appointment of the Receiver at a preliminary injunction hearing in December.

Since the commencement of this action, the Receiver has been working to discover, marshal, and preserve funds and assets derived from the consumers. This website was created to provide information to all consumers and third parties regarding the efforts of the Receiver to discover, marshal and preserve for the benefit of all consumers the funds and assets of the Receivership Defendants.
